JAC Roadside Assist is not required to provide any services where any of the following occur:
(a)Unauthorised modifications: The JAC Vehicle has undergone unauthorised modifications that are not in conformity to the manufacturer’s specifications for pursuits such as racing, trials or rallying. This also applies for any accident or any claim for services which have arisen in respect of such races, trails, rallies or participation in activities of the like. Damage caused by the fitment of non-genuine accessories will also void JAC Roadside Assist.
(b) Towing: The JAC Vehicle is carrying more passengers or towing a greater weight than the design intended, as stated in the manufacturers’ specifications, or arising from or in connection with the improper, unauthorised, reckless or negligent operation or misuse of the JAC Vehicle.
(c)Mechanical breakdown due to any customer-related damage or misuse of the JAC Vehicle. This applies to activities other than changing a flat tyre, jump-starting a flat battery, supplying emergency fuel and effecting minor roadside repairs which are safe to do at the breakdown scene. In such cases, the services may still be provided, however the customer will be responsible for all costs.
(d)Failure to service: The JAC Vehicle is in an un-roadworthy condition, or it has not been regularly serviced, or has not been serviced in accordance with the manufacturer’s requirements and the Capped Price Service Program.
(e)Force majeure events: Loss or damage directly or indirectly occasioned by, or happening, or in consequence of the following: war, invasion, act of God, environmental events such as flooding, hail, act of foreign enemies, hostilities whether war be declared or not, civil war, rebellion, insurrection, terrorism, military and usurped power, riot or civil commotion, or sabotage, or any other events (whether falling into the same genus, species, class or category as the foregoing or not) beyond the control of you or the person operating or having control of the vehicle at the time of the accident.
The JAC Vehicle must be on a public and serviceable road.
In the event that JAC Roadside Assist transports the vehicle following any failure that is not covered by these terms and conditions, you will be responsible for all costs incurred, including parts, labour and vehicle transport costs.
Any person driving the vehicle must be holding a valid driver’s licence issued by a competent authority.
